Engage Optics (Pty) Ltd, registration 2020/649704/07, VAT 4860306085, trading as Engage Optics and as Arken Optics SA. Version 1.0, effective 28 September 2026. These terms apply to sales on engageoptics.co.za and arkenoptics.co.za and to all trade sales.

1. Application of these terms

1.1 These terms apply to every sale of goods by Engage Optics (Pty) Ltd (“we”, “us”), whether through engageoptics.co.za, arkenoptics.co.za, by email, telephone or in person, and whether to a consumer or to a trade customer.

1.2 In these terms:

Consumer

A natural person, or a juristic person with an asset value or annual turnover below the threshold in the Consumer Protection Act 68 of 2008 (“CPA”), buying for their own use.

Trade customer

A dealer, retailer or other business buying for resale or for use in its business, including every customer on a wholesale price tier.

Goods

Optics, mounts, accessories and any other products we sell.

1.3 Nothing in these terms excludes or limits a right a consumer has under the CPA or the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”). Where a clause would do so, it applies only to trade customers.

1.4 For a trade customer, a signed dealer agreement, a credit facility letter and a signed credit application form part of the contract. If they conflict with these terms, the signed document prevails for that customer.

1.5 By placing an order you accept these terms as they stand on the date of the order. We may change them by publishing a new version on our websites. Changes do not affect orders already placed.

2. Orders and acceptance

2.1 An order, whether placed online, by email or by telephone, is an offer to buy. A contract is formed when we confirm the order by email or dispatch the goods, whichever is first. An automated order-received email is an acknowledgement, not an acceptance.

2.2 We may decline or cancel an order before dispatch, including where goods are unavailable, where a price or description on the website was plainly wrong, or where payment has not cleared. If we cancel, we refund any amount paid in full.

2.3 Stock levels shown online are indicative. If an item on a paid order is not available, we will offer a backorder, a substitute or a refund for that item.

2.4 A customer may cancel or change an order without charge until it has been processed for dispatch. After that, clause 7 applies.

2.5 You must be 18 or older to buy from us. Optics and accessories are not firearms, but you are responsible for complying with any law that applies to your use of them.

3. Prices and VAT

3.1 All prices are in South African rand and include VAT at the current rate, unless a price list or quotation states otherwise.

3.2 Prices may change without notice. The price that applies is the price on the website, price list or quotation at the time the order is placed, except where clause 2.2 applies.

3.3 A written quotation is valid for 7 days unless it states another period, and is subject to stock being available when the order is placed.

3.4 Delivery charges are shown separately at checkout or on the invoice and are payable with the goods.

3.5 Trade prices are confidential to the trade customer. Any recommended retail price we publish is a recommendation only. Trade customers set their own resale prices.

4. Payment

4.1 Consumers pay in full before dispatch, by any payment method offered at checkout or by electronic transfer against our invoice.

4.2 Trade customers pay in full before dispatch unless we have granted a credit facility in writing. A credit facility is governed by the credit facility letter issued for it, including its limit, payment cycle and account-hold rules.

4.3 Payment by electronic transfer must be made to the bank account shown on our invoice, using the order or invoice number as reference. We do not change banking details by email alone. If you receive a notice of new banking details, confirm it by telephone with us on 021 300 6782 before paying.

4.4 An order is released for dispatch once payment reflects in our account. Proof of payment speeds this up but is not itself payment.

4.5 Where a payment gateway charges a fee on a refund, the fee is deducted from the refund except where the refund is for defective goods or our error.

4.6 A trade customer may not withhold or set off any amount against our invoices.

4.7 On a trade account, any amount not paid by its due date bears interest at the maximum rate permitted by law from the due date until paid, and the customer is liable for our costs of collection on the attorney-and-own-client scale. A certificate by one of our directors or managers is prima facie proof of the amount owing.

5. Delivery

5.1 In-stock orders are dispatched within 1 to 2 business days from Somerset West, Western Cape, by courier. Delivery normally takes 2 to 5 business days depending on the address. Delivery times are estimates, not guarantees.

5.2 We email a tracking number when the order ships. If tracking shows the parcel as delivered and you have not received it, tell us within 7 days so that we can raise it with the courier.

5.3 Delivery is to the address given on the order. If delivery fails because the address or contact details were wrong or incomplete, the cost of redelivery is for the customer’s account.

5.4 Inspect the goods on receipt. Report damage in transit, a short delivery or an incorrect item to us within 7 days of delivery, with photographs where relevant. This does not affect a consumer’s rights under the CPA for defects discovered later.

5.5 Collection from our Somerset West office is available by appointment.

5.6 We deliver within South Africa. Delivery to Namibia or elsewhere is by prior arrangement only, and any duties, taxes and clearing charges at the destination are for the customer’s account.

6. Risk and ownership

6.1 Risk in the goods passes to the customer on delivery to the address on the order, or on collection.

6.2 Ownership of the goods remains with us until we have received payment in full for them. Until then a trade customer may sell the goods in the ordinary course of its business but may not pledge or encumber them, and must keep them identifiable as our stock. If a trade account is in arrears we may, on notice, recover unpaid goods still in the customer’s possession, without prejudice to our other rights.

7. Returns, cancellations and refunds

7.1 Consumer cooling-off. A consumer who buys online or by other electronic means may cancel the purchase within 7 days of delivery under section 44 of ECTA, for any reason. The goods must be returned in original condition and packaging with all accessories. The consumer pays the direct cost of returning the goods. We refund the price within 30 days of receiving the goods.

7.2 30-day returns. Beyond the cooling-off period, we accept a return for refund or exchange within 30 days of delivery, provided the goods are unused, in original condition and packaging, with all accessories and proof of purchase. Return shipping is for the customer’s account and the original delivery charge is not refunded. Returns after 30 days are at our discretion.

7.3 Defective goods. Under sections 55 and 56 of the CPA a consumer may return goods that are defective, unsafe or not fit for purpose within 6 months of delivery, and choose a repair, a replacement or a refund. For defective goods we arrange and pay for the courier both ways within South Africa.

7.4 How to return. Contact us with the order number, the product and the reason before sending anything back. We issue a return authorisation with instructions. Goods sent without authorisation may be refused. Do not send goods to the manufacturer.

7.5 Inspection. Refunds and exchanges are processed after we have received and inspected the goods. A refund goes to the original payment method, normally within 5 business days of approval; banks may take longer to reflect it. Goods returned used, damaged or incomplete may be refused or refunded at a reduced value.

7.6 Trade customers. Trade customers may not return goods for change of mind. Short deliveries, incorrect items and transit damage must be reported under clause 5.4, and defective goods are handled under the warranty in clause 8. Any other return is at our discretion and may carry a handling charge.

7.7 Returns and refunds apply only to goods bought from us. Goods bought from an unauthorised seller are not eligible.

8. Warranty

8.1 Day optics. Riflescopes, red dot and reflex sights, spotting scopes, binoculars, mounts and rings bought from us carry a fully transferable lifetime warranty against defects in materials and workmanship under normal use, on the terms published at arkenoptics.co.za/lifetime-warranty. The warranty follows the product, not the purchaser.

8.2 Digital products. Digital night-vision, thermal and other electronic optics, and laser rangefinders, carry a 2-year warranty from the date of purchase on the same terms.

8.4 Under the warranty we repair the product at no charge or, where repair is not possible, replace it with the same or a comparable model. The warranty does not cover loss, theft, deliberate damage, cosmetic damage that does not affect function, misuse, neglect, or unauthorised disassembly, modification or repair. Batteries and other consumables are not covered.

8.5 Warranty claims are submitted through warranty.arkenoptics.co.za. We arrange courier collection for valid claims within South Africa, and typical turnaround is 7 to 14 business days after we receive the product. Proof of purchase is required. Product registration is recommended but not required.

8.6 The warranty is in addition to, and does not reduce, the 6-month implied warranty of quality that consumers have under section 56 of the CPA.

9. Product information

9.1 We take care to describe products accurately, but specifications, reticle designs, colours and packaging may change without notice, and images are illustrative. Where a specification matters to you, confirm it with us before ordering.

9.2 Choosing goods that suit your rifle, calibre, mounting system or intended use is the customer’s responsibility. We give advice in good faith, but it is not a guarantee of fitness for a particular purpose unless we confirm it in writing.

10. Liability

10.1 To the extent the law allows, our liability for any claim arising from a sale is limited to the price paid for the goods concerned, and we are not liable for indirect or consequential loss, including loss of profit, loss of a hunt or competition, or damage to a firearm or other property arising from installation or use of the goods.

10.2 This clause does not limit liability for death or injury caused by our gross negligence, or any liability that cannot be excluded under the CPA.

11. Personal information

11.1 We process personal information to fulfil orders, handle warranty claims and, where you have agreed, send you product news. We handle it under the Protection of Personal Information Act 4 of 2013 and our privacy policy published on each website.

12. General

12.1 These terms are governed by the law of the Republic of South Africa. For a trade customer, we may bring proceedings in the Magistrate’s Court under section 45 of the Magistrates’ Courts Act even where the claim exceeds that court’s jurisdiction.

12.2 If a clause is found to be unenforceable, the rest of the terms remain in force.

12.3 No relaxation or indulgence by us is a waiver of our rights.

12.4 Notices to us go to anton@engageoptics.co.za or to 5 Dewberry Drive, Bel’Aire Winelands Estate, Somerset West, 7135. Notices to a customer go to the email or address on the order or account.
